Terms of sale
Last updated: 27 October 2026
Article 1 – Seller
The website fibernium.com (hereinafter the “Site”) is operated by:
Loïs Carlier EI (sole proprietorship), trade name Fibernium
Business address: 60 rue François Ier, 75008 Paris, France (postal address)
RCS Paris 102 486 073 – SIRET: 102 486 073 00012
E-mail: contact@fibernium.com – Phone: +33 6 37 91 20 80 (standard-rate call)
VAT not applicable, Article 293 B of the French General Tax Code (Code général des impôts).
Hereinafter “Fibernium” or the “Seller”.
Article 2 – Scope
These general terms and conditions of sale (GTC) apply to all sales of products concluded on the Site between Fibernium and any person who places an order (hereinafter the “Customer”). The protective provisions specific to consumers apply to any natural person acting for purposes that fall outside the scope of their commercial, industrial, craft, professional or agricultural activity.
The GTC are accessible at any time on the Site and are brought to the Customer's attention before the order is validated. The applicable version is the one in force on the date of the order. Validation of the order constitutes acceptance of the GTC.
The GTC are drafted in French and translated on the Site. In the event of any discrepancy between the language versions, the version most favourable to the consumer shall apply.
Article 3 – Products
The essential characteristics of each product (material, finish, compatible device model, features) are presented on its product page. The exact composition is stated there: some products are made of carbon fibre, others combine carbon fibre with another material (for example aramid) or are made of fibreglass with a carbon look.
The photographs are as faithful as possible. As the weave and pattern of the carbon, in particular forged carbon, are unique to each piece, slight variations in pattern or shade may occur, as may differences related to the display of each screen.
It is the Customer's responsibility to select the device model that matches their own. In the event of an error, the Customer may exercise their right of withdrawal (Article 8).
Products are offered while stocks last. If an ordered product turns out to be unavailable, the Customer is informed without delay and may choose another product or be refunded the sums paid no later than 14 days after their request.
Article 4 – Prices
Prices are stated in euros. VAT not applicable (Article 293 B of the French General Tax Code): the price displayed is the total price paid by the Customer. Standard delivery is free of charge.
For deliveries to metropolitan France and the rest of the European Union (excluding the territories mentioned below), any duties, taxes and customs clearance fees are borne by Fibernium: should they be claimed from the Customer on delivery, Fibernium reimburses them upon presentation of proof. For deliveries outside the European Union or to a territory located outside the fiscal territory of the Union (for example the French overseas departments and regions or the Canary Islands), customs duties, taxes and customs clearance fees may be claimed from the recipient by the carrier or the authorities of the destination country. They remain payable by the Customer.
When a price reduction is announced, the struck-through reference price corresponds to the lowest price charged by Fibernium during the 30 days preceding the application of the reduction (Article L. 112-1-1 of the French Consumer Code (Code de la consommation)). Bundle offers (for example a discount from two items) are calculated on the unit price in force.
The applicable price is the one displayed at the time the order is validated. In the event of an obvious clerical error in a price (derisory price), Fibernium may cancel the order and refund the Customer in full.
Article 5 – Orders
To place an order, the Customer selects the product(s) and the device model, adds them to the cart, enters their contact details and delivery address, checks the order summary (and may correct any error at this stage), then validates the order by proceeding to payment. The order is concluded upon confirmation of payment.
Fibernium sends the Customer, by e-mail, a confirmation of their order including the information provided for in Article L. 221-5 of the Consumer Code, these GTC and the withdrawal form.
Fibernium may refuse or cancel an order in the event of non-payment, serious suspicion of fraud or an unresolved payment incident on a previous order. The Customer is informed accordingly and any sum paid is refunded.
For any order of €120 or more, Fibernium keeps the written record of the contract for ten years and guarantees the Customer access to it upon simple request (Article L. 213-1 of the Consumer Code).
Article 6 – Payment
Payment is due at the time of order. Accepted payment methods: bank card (CB, Visa, Mastercard), Apple Pay and Shop Pay. Payments are processed by secure payment service providers: Fibernium never has access to the Customer's bank card details. The Customer's account is debited when the order is validated.
Article 7 – Delivery
Areas. Fibernium delivers to France, to all countries of the European Union and to most other countries. If a country is not offered when the address is entered, Fibernium cannot deliver there. Products are delivered to the address provided by the Customer. Standard delivery is free of charge.
Delivery times, from confirmation of the order:
- metropolitan France: 5 to 10 business days;
- other European Union countries: 7 to 15 business days;
- French overseas territories and other destinations: 10 to 20 business days.
An order of several items may be delivered in several parcels, at no extra cost. A tracking number is sent by e-mail upon dispatch; it may change when the parcel is handed over to the carrier responsible for final delivery, in which case the new number is provided upon simple request.
Late delivery. If the order is not delivered within the stated time, the Customer may give Fibernium formal notice, by e-mail or by post, to make the delivery within a reasonable additional period. If delivery is not made within this new period, the Customer may terminate the contract by e-mail or by post. The Customer may terminate the contract immediately if Fibernium refuses to deliver or if the delivery time was an essential condition of the contract for them. The Customer is then refunded all sums paid within 14 days at the latest (Articles L. 216-6 and L. 216-7 of the Consumer Code).
Loss and damage in transit. The risk of loss of or damage to the products is borne by Fibernium until the Customer, or a third party designated by them, takes physical possession of them (Article L. 216-4 of the Consumer Code). A parcel that is lost or arrives damaged is therefore replaced or refunded, at no cost to the Customer. It is recommended that the condition of the parcel be checked upon receipt and that any damage be reported as soon as possible, with supporting photos, in order to speed up processing; this step is not a condition of the Customer's rights.
Incorrect address. If the parcel is returned to the sender because of an incomplete or incorrect address provided by the Customer, the cost of re-shipping may be charged to the Customer.
Customs formalities. For deliveries subject to customs formalities (see Article 4), the Customer provides the information requested by the carrier or the authorities (for example an identification number) to allow the parcel to be delivered.
Article 8 – Right of withdrawal
Period. The consumer Customer has a statutory period of 14 days in which to withdraw, without having to give any reason or pay any penalty. Fibernium extends this period to 30 days from receipt of the product (or of the last product, in the case of delivery in several parcels). The conditions below apply throughout this entire period. The Customer may withdraw as soon as the contract is concluded, without waiting for receipt. No product sold on the Site is excluded from the right of withdrawal, including discounted items.
How to withdraw. The Customer informs Fibernium of their decision before the period expires:
- by sending the withdrawal form set out in the annex, by e-mail to contact@fibernium.com or by post to the address stated in Article 1;
- or by any other unequivocal statement expressing their wish to withdraw.
Fibernium acknowledges receipt of the request by e-mail.
Return of products. Products are to be returned to an address located in metropolitan France, which is sent to the Customer by e-mail together with the return instructions. The Customer returns the products without undue delay and no later than 14 days after communicating their decision to withdraw. Return costs are borne by the Customer. Products are to be returned complete, if possible in their original packaging. The Customer is liable only for any diminished value of the product resulting from handling other than what is necessary to establish its nature, characteristics and functioning (for example scratches caused by prolonged use); the amount of this diminished value may then be deducted from the refund.
Refund. Fibernium refunds all sums paid, including the initial delivery costs, no later than 14 days from the date on which it is informed of the decision to withdraw. This refund may be withheld until the products have been recovered or until the Customer has supplied proof of having sent them back, whichever is the earlier. The refund is made using the means of payment used for the order, at no cost to the Customer.
Exchange. To obtain another model or another finish, the Customer returns the product according to the procedure above and places a new order.
Article 9 – Legal guarantees
All products sold on the Site benefit from the legal guarantee of conformity and the legal guarantee against hidden defects, under the conditions set out below.
Making a claim. The Customer contacts Fibernium at contact@fibernium.com, stating their order number, describing the defect and, if possible, attaching a photo. Fibernium bears all costs (any return of the product and shipping of the replacement product) and may exempt the Customer from returning the defective product.
The products protect the device against scratches and everyday wear; they are not designed to absorb shocks or falls. Damage resulting from a fall, an impact, a modification of the product or abnormal use is not covered by the legal guarantee, unless it is the consequence of a defect in the product.
The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event that a lack of conformity appears. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.
Where the contract of sale of the goods provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the intended period of supply. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.
The legal guarantee of conformity entails an obligation for the professional, where applicable, to provide all updates necessary to keep the goods in conformity.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date on which the goods are replaced.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund in return for giving back the goods, if:
1° The professional refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after a period of thirty days;
3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer definitively bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4° The lack of conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a reduction in the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. The consumer is then not required to request repair or replacement of the goods first.
The consumer is not entitled to termination of the sale if the lack of conformity is minor.
Any period during which the goods are out of use for the purpose of repair or replacement suspends the remaining guarantee period until delivery of the restored goods.
The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code.
A seller who in bad faith obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to up to 10% of average annual turnover (Article L. 241-5 of the Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects pursuant to Articles 1641 to 1649 of the French Civil Code (Code civil), for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept or to a full refund in return for giving back the goods.
Article 10 – Liability
Fibernium is liable as of right for the proper performance of the obligations arising from the contract, including where they are performed by service providers (in particular carriers). It may only be exempted from all or part of its liability by proving that the non-performance or improper performance is attributable to the Customer, to the unforeseeable and insurmountable act of a third party to the contract, or to force majeure. No provision of these GTC limits the rights the Customer enjoys under the law.
Article 11 – Customer service and complaints
For any question or complaint, the Customer may contact Fibernium by e-mail at contact@fibernium.com, by phone on +33 6 37 91 20 80 or by post at the address stated in Article 1. Fibernium replies as quickly as possible, generally within 48 business hours.
Article 12 – Consumer mediation
In the event of a dispute that remains unresolved after a written complaint to customer service, the consumer Customer may refer the matter free of charge to the consumer mediator responsible for Fibernium, within one year of their written complaint. The mediator's contact details will be provided here shortly.
A Customer residing in another European Union country may also contact the European Consumer Centre France (Centre européen des consommateurs France, europe-consommateurs.eu).
Article 13 – Personal data
The Customer's personal data is processed in accordance with the Site's privacy policy and legal notice.
Article 14 – Applicable law and disputes
These GTC are governed by French law. This choice does not deprive the consumer Customer residing in another country of the protection afforded to them by the mandatory provisions of the law of their country of residence. In the event of a dispute, the Customer may bring proceedings, at their choice, before the court of the place where they resided at the time the contract was concluded or the harmful event occurred, or before any other court having jurisdiction under the law.
