1. Purpose

These terms of use govern access to the website fibernium.com (hereinafter the “Site”), published by Loïs Carlier EI (sole proprietorship), trade name Fibernium (see the legal notice). Purchases are governed by the general terms and conditions of sale, which prevail in the event of any conflict.

2. Access to the Site

The Site is accessible free of charge. Fibernium may suspend access to it for maintenance or updates. The Site is hosted by Shopify; all sales are concluded exclusively between the Customer and Fibernium.

3. Customer account

Creating an account is optional: it is possible to order without an account. The account allows users to track their orders and manage their information. Access is via a login code sent by e-mail; the user ensures the security of their mailbox and informs Fibernium of any unauthorised use of their account.

4. Prohibited uses

It is prohibited to use the Site for unlawful purposes, to attempt to disrupt its operation or circumvent its security measures, to collect data of other users, or to copy its content on a large scale in order to reproduce it. Automated access (bots, software agents, artificial intelligence tools) is permitted provided that it identifies itself, complies with the robots.txt file and does not disrupt the operation of the Site.

5. Reviews and published content

A user who publishes a review warrants that it relates to a product they have actually purchased and used, and that it contains no unlawful, abusive or defamatory statements, nor any personal data of third parties. They authorise Fibernium to display it on the Site with their first name and the initial of their surname. Any reuse in other communications (social networks, advertisements) is subject to their consent. The rules for collecting and moderating reviews are described in the legal notice.

6. Intellectual property

The content of the Site (texts, photographs, logos, videos) is protected. Any reproduction without prior written permission is prohibited.

7. Liability

Fibernium implements reasonable means to ensure the accuracy of the information and the availability of the Site. These provisions do not limit the rights that consumers enjoy under the law, in particular under the legal guarantees.

8. Personal data

Personal data is processed in accordance with the privacy policy and the legal notice.

9. Changes

Fibernium may amend these terms. The applicable version is the one online at the time the Site is used.

10. Applicable law

These terms are governed by French law. This choice does not deprive a consumer residing in another country of the protection of the mandatory provisions of their law. The procedures for settling disputes, including consumer mediation, are set out in the general terms and conditions of sale.
